5.2These Terms are always available on our website. We encourage you to review them regularly.

Minor changes that do not affect your rights and obligations take effect upon publication on the Site. We will notify you of significant changes by email at least six weeks before they take effect. If you have a paid subscription, such changes will take effect no earlier than the start of your next Subscription Period.

5.4Changes affecting essential terms of the contract, such as the scope of the Service, the term or the prices, will only take effect with your express consent. 6.1To use eCift, you must:

•be aged 18 years old or over (confirmed by your date of birth at registration);

•not be barred from using eCift by us previously, or under the laws of your country of residence or any other applicable laws;

•not have ever been convicted of a hate crime, a terrorism offence, a violent offence, or a sexually related criminal offence; and

•register as a member of eCift by creating an account (an “Account”).

6.2You may only use eCift for individual, personal, and non-commercial purposes.

6.3Access to eCift and all content available on it is subject to your compliance with these Terms, and in particular with the Community Standards set out in Section 8.

6.4Use of the App is subject to your device meeting the minimum technical specifications required by the Apple App Store or Google Play Store.

6.5You are responsible for all arrangements necessary to access eCift, including any applicable data charges.

7.Account Registration

7.1You may create an Account using your email address, a Facebook account, a Google account, or an Apple ID account, or other third-party provider. Where you use a third-party account, we may access personal information from that provider (e.g. email address, name, and date of birth). Further details are set out in our Privacy Policy.

7.2If registering by email, you must: (a) be the sole owner and operator of the email address you provide; and (b) be the sole owner and operator of the mobile phone number you provide, and verify it.

7.3If registering via a third-party account, you confirm that: (a) the third party has verified that you are 18 or over; (b) you are the only user of that third-party account; and (c) you provided accurate, current, and complete information when originally opening the third-party account.

7.4You must provide accurate, complete, and up-to-date information when opening your Account and keep it updated thereafter. Failure to do so may result in the suspension or termination of your Account.

7.5You are responsible for all activity that occurs through your Account. You must not share your login credentials with any other person, and you must notify us immediately at support@ecift.com if you suspect unauthorised access to your Account.

7.6You may not create an Account on behalf of another person or using another person’s name or identity.

7.7Creating more than one member profile, whether with the same or with different details, is strictly prohibited. If we detect this, all of your Accounts will be closed without prior notice; where a paid subscription exists, the fee paid will not be refunded.

7.8eCift assesses member profiles using social and psychological criteria based on scientific research. Your member profile is created on the basis of the personality analysis questions you answer during registration. This profile is subjected to a compatibility analysis and used to match you with members whose characteristics are closest to yours. eCift does not guarantee the accuracy of the personality analysis results or that any particular relationship will result.

7.9Your profile is displayed on the Service once it has been approved by eCift. Approval of a profile does not constitute any assurance as to the accuracy of its content.

7.10Your member profile must not contain personal contact details such as an email address, telephone number, home address or web address. Profiles containing such details may be suspended or deleted until the details have been removed.

7.11You must state your marital status, occupation, level of education and any other information requested by eCift completely and truthfully. If we find that information is false, your membership will be terminated immediately and the fee paid will not be refunded. The marital status “separated” may only be selected by members for whom legal divorce proceedings have already been initiated.

7.12Where we identify inconsistencies between your statements and the documents you have provided, where complaints have been made about you or where there are comparable legitimate reasons, we may verify your information in order to ensure the safety of our members and the quality of the Service. For this purpose we may request additional information and documents, including an identity document and official evidence of your marital status, and may access information that you have made public yourself. If you do not provide the requested information and documents within a reasonable period, we may restrict or suspend your Account in accordance with Section 18 until the verification has been completed. Personal data collected in this context is processed in accordance with Section 1.5 and our Privacy Policy.

•include images or recordings of another person without their consent.

8.4Messaging rules

Private messages you send to other members must not contain defamatory, insulting, threatening, harassing or immoral content. In addition, you must not send other members advertising or messages with a commercial purpose, advertise in any way, spread propaganda for any political view or religion, share content that promotes racism, bigotry, hatred or physical harm against any individual or group, share immoral sexual content, promise or request money or anything of monetary value, or direct members to any other website. eCift is designed solely for the individual use of its members and may not be used by organisations, companies or businesses for any commercial or other purpose.

Where a breach of these rules is suspected, your messages may be reviewed by automated systems or following a complaint by a member. If the review shows this to be necessary, your profile may be removed, your messaging rights may be restricted or your membership may be terminated. In that case, fees already paid will not be refunded.

Sending more messages per day than the limit set by eCift is prohibited. Your messages may also be deleted if you do not log in to the Service for a period announced by eCift.

8.5Moderation

We are not obligated to monitor access to or use of eCift or to review all User Content. However, we reserve the right (without obligation) to monitor, moderate, edit, restrict, or remove any User Content that we determine is in breach of these Terms. We use a combination of automated and manual tools. We may also cooperate with law enforcement authorities where required.

We will review User Content if it is flagged through our moderation process, reported by a user, relevant to an investigation, or the subject of a technical issue. You agree that we may access and use your content for these purposes.

9.Reporting Violations

9.1If you believe that any content on eCift infringes third-party rights, is untrue, offensive, obscene, unlawful, misleading, or otherwise fails to comply with these Terms, please notify us by emailing support@ecift.com or using the ‘Report’ button in the App.

9.2Upon receiving a complaint, we will review the relevant content and take appropriate action.

III. Content & Intellectual Property

10.User Content

10.1Members of eCift may store or share content such as text, files, images, messages, and other materials (“User Content”).

10.2All User Content you post is referred to as “Your Content”. Your Content must comply with these Terms, including the Community Standards in Section 8. You are solely responsible for all Your Content.

10.3We do not claim ownership of Your Content. By posting it, you grant eCift a non-exclusive, worldwide, royalty-free, perpetual licence (with the right to sub-licence to service providers and other members) to use, copy, modify, distribute, publicly display, and publicly perform Your Content on and in connection with eCift.

10.4We may exercise all copyright and related rights in Your Content to the full extent permitted by law.

10.5You must hold all rights necessary to grant the licence described in Section 10.3.

10.6We do not endorse any User Content and bear no obligation to monitor, edit, or remove it (see Section 8.5 for moderation details). The views of other members do not represent our views or values.

10.7You may delete Your Content by using the relevant deletion function in the App.

11.Our Intellectual Property Rights

11.1We own or are licensed to use all intellectual property rights in eCift and in all materials published by us on it. These works are protected by copyright, trade mark, and other intellectual property laws worldwide.

11.2The eCift name, logo, and related marks are our trade marks. You are not permitted to use them without our prior written approval.

11.3You may view, download, print, and quote from eCift for your own personal, non-commercial use only, provided that you give appropriate acknowledgement where required. Any such acknowledgement should include a link to www.ecift.com.

11.4You must not modify materials you have printed or downloaded, and you must not use any images, video, audio, or other content separately from the accompanying text.

11.5You may not use eCift or its content for any purpose other than those set out in these Terms.

11.6If you print, copy, download, share, or repost eCift content in breach of these Terms, your right to use eCift will cease immediately, and you must, at our option, return or destroy any copies you have made.

12.App Licence & Third-Party Platform Terms

12.1Licence grant. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and install the App on your personal device(s) for your own personal, non-commercial use.

12.2Restrictions. You may not: (i) copy, modify, or create derivative works based on the App; (ii) distribute, sublicence, lease, or rent the App; (iii) reverse engineer, decompile, or disassemble the App (except as required by applicable law); or (iv) make the App’s functionality available to multiple users simultaneously.

12.3Apple App Store. If you download the App from the Apple App Store or use it on an iOS device: Apple has no obligation to provide maintenance or support for the App; in the event of any warranty failure, Apple will refund the purchase price (if applicable); Apple is not responsible for any product liability or legal compliance claims; Apple is not responsible for any third-party intellectual property claims relating to the App; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not in a country subject to a U.S. government embargo or terrorist designation, and you are not on any U.S. government prohibited parties list. You must also comply with applicable third-party terms of service.

12.4Google Play. If you download the App via Google Play, the relevant Google Play terms of service also apply to your use.

IV. Purchases, Subscriptions & Cancellations

13.Products & Services

13.1We may make various products and services available for purchase within eCift (“eCift Products”), including one-off purchases and subscription-based plans (e.g. eCift Premium).

13.2Order process. To make a purchase, click the relevant ‘Purchase’ button. Additional terms disclosed at the point of purchase will form part of your agreement with us.

13.3Prices. Prices for eCift Products are shown in the App and include VAT or equivalent tax at the applicable rate. Prices may change at any time, but changes will not affect existing orders except where there is a pricing error.

13.4Payment. Payment is made by credit card, via the Apple App Store, Google Play Store or any other payment method available (“Payment Method”). All card payments must be authorised by the relevant card issuer. Payment is taken at the time you place your order.

13.5Instalment payment. If the available limit on your credit card is not sufficient to cover the full subscription fee, you may choose monthly instalments. In that case, the first instalment is charged to your credit card on the start date of your subscription and further instalments at intervals of thirty (30) days. eCift is not responsible for disputes between you and your bank relating to these charges.

14.Subscription & Auto-Renewal

14.1IMPORTANT: subscriptions automatically renew. Please read this section carefully.

14.2If you purchase an eCift Premium subscription, you will be charged the subscription fee stated in the App at the start of your subscription. You may choose a subscription period of one week, one month, three months, six months, or one year (“Subscription Period”).

14.3Your subscription will automatically renew at the end of each Subscription Period. By purchasing a subscription, you authorise us to take recurring payments through your chosen Payment Method until you cancel.

14.4Promotions. eCift may from time to time run promotions for Premium membership. A Premium membership purchased under a promotion will, unless cancelled in time in accordance with Section 14.6, renew automatically at the end of the promotional period on the terms of Section 14.3. The renewal is charged not at the promotional price but at the standard Premium membership fee applicable on the renewal date.

14.5Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the then-current Subscription Period, and no refund is given for any unused portion of that period. You may cancel by sending an email to support@ecift.com stating the security password shown in your profile, or directly via the Apple App Store or Google Play Store. For your cancellation to prevent renewal for a further Subscription Period, the deadline in Section 14.6 must be met. Deleting the App or your Account alone does not cancel your subscription.

14.6Stopping auto-renewal. If you do not wish your subscription to renew automatically, your cancellation must reach us no later than 14 (fourteen) days before the end of the current Subscription Period, by email to support@ecift.com stating the security password shown in your profile or via the Apple App Store or Google Play Store. If no valid cancellation is received within this period, the subscription renews automatically for a further Subscription Period, and the cancellation then takes effect at the end of the renewed Subscription Period.

14.7Security password. For cancellations by email, stating the security password shown in your profile is required for identification. Emails without the security password do not constitute a valid cancellation and will not be processed; in that case we will inform you by email so that you can provide the missing information. The date on which the complete cancellation is received is decisive for the deadline in Section 14.6.

14.8Refund on marriage. If you marry during your membership and notify us of this by sending an official marriage certificate to support@ecift.com, we will refund the unused portion of the subscription fee attributable to the period after the change in your marital status.

14.9Insufficient funds. If the available limit on your credit card is insufficient on the auto-renewal date, your Premium membership will be temporarily converted into a Standard membership until the full fee has been collected; once payment has been collected, your Premium membership will be reactivated.

15.Your Right of Withdrawal

15.1If you are a consumer resident in the European Union, the European Economic Area or the United Kingdom, you have a statutory right to withdraw from contracts for eCift Products. You may withdraw from the contract within 14 days from the day the contract is concluded without giving any reason.

15.2To exercise your right of withdrawal, you must inform us of your decision to withdraw by an unequivocal statement, for example by email to support@ecift.com, by letter to the address set out in Section 2.2 or via the withdrawal function (“Withdraw from contract”) on the Site or in the App. To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.

15.3If you withdraw from the contract, we will reimburse all payments received from you without undue delay and in any event no later than 14 days from the day on which we are informed of your withdrawal. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

15.4By completing your purchase, you expressly request that we begin providing the Service before the end of the withdrawal period. If you withdraw from the contract, you must pay us an amount proportionate to what has been provided up to the time you informed us of your withdrawal, in comparison with the full coverage of the contract. This amount is calculated pro rata temporis on the basis of the total price and is set off against the reimbursement under Section 15.3.

15.5The right of withdrawal expires once we have fully performed the Service, provided that performance began with your prior express consent and your acknowledgement that you would lose your right of withdrawal once the contract had been fully performed.

15.6If you purchased an eCift Product via the Apple App Store or Google Play Store, payments and refunds are processed by the relevant store operator. You may nevertheless also notify us of your withdrawal.

V. Service Management

16.Changes to eCift

16.1eCift evolves over time. Both we and our members may update content at any time.

16.2We will provide updates (including security updates) to ensure eCift continues to comply with the terms of our contract with you. We may ask you to install these updates.

16.3We may make changes to eCift to:

•comply with applicable laws and regulations;

•address changes in law or regulation;

•make minor technical adjustments or improvements (e.g., to address security concerns); or

•update digital content such as the App (provided it continues to match the description provided before purchase).

16.4We may also modify eCift to reach a greater number of users, improve or add services, address operational needs, or remove unpopular features. We will inform you of any significant change by email, including: (a) a description and timing of the modification; and (b) your right to close your Account as set out in Section 19. There will be no additional cost to you for such changes.

17.Service Withdrawal

We reserve the right to stop providing eCift or any eCift Products at any time. Where we do not consider you to be at fault, we will provide reasonable advance notice before doing so.

18.Suspension or Termination of Your Account

18.1We may restrict, suspend, or close your Account with immediate effect at any time if we reasonably believe you are in breach of these Terms or are misusing eCift. Where we close your Account for a breach, you will not be entitled to a refund for any unused eCift Products.

18.2Restrictions on your access may include limiting your number of connections and restricting your ability to contact other members.

18.3We may also close your Account for legitimate business reasons by giving you notice by email.

18.4We may temporarily suspend the supply of eCift or eCift Products to: (a) deal with technical problems or make minor technical changes; (b) implement updates required by changes in law or regulation; or (c) make modifications to eCift as described in Section 16. We will notify you in advance unless the issue is urgent.

19.How to Close Your Account

19.1You may close your Account at any time by: (a) sending an email to support@ecift.com; or (b) selecting ‘Delete Account’ in the App settings and following the on-screen steps.

19.2Important: If you have an active paid subscription, you must cancel it separately to stop further charges; closing or deleting your Account alone does not cancel your subscription. Cancellation must be made in accordance with Sections 14.5, 14.6 and 14.7 no later than 14 (fourteen) days before the end of the current Subscription Period, by email to support@ecift.com stating the security password shown in your profile or via the Apple App Store or Google Play Store. The security password is also required for identification when closing your Account by email.

20.Consequences of Account Closure

20.1When your Account is closed, your access to eCift will end. You will lose all purchases, matches and other data associated with your Account; however, you may request reactivation of your profile within six months of closure by emailing support@ecift.com. Reactivation covers your profile only; any unused Premium membership periods and other paid entitlements existing before closure will not be reactivated.

20.2We will cease using and delete all content stored in your Account and your user details, except where we are required by law to retain them.

20.3Any user details we are required to retain will be archived after two years in an inactive database, in accordance with our Privacy Policy.

VI. Liability & Responsibility

21.Service Quality & Your Remedies

21.1We will operate eCift and provide eCift Products using reasonable skill and care.

21.2If you believe there is something wrong with eCift or your eCift Product, please contact our support team at support@ecift.com.

22.Your Responsibility

22.1You are solely responsible for your interactions with other members, both on and off eCift. Always exercise appropriate judgement and take sensible safety precautions when communicating with or meeting other members, including protecting your personal information.

22.2You must report all suspicious or offensive behaviour, and any concerns about other members or their content, by emailing support@ecift.com or using the ‘Report’ button in the App.

23.Our Liability to You

23.1Although we take all reasonable care to ensure that eCift operates to a satisfactory standard, certain features rely on networks and connections beyond our control. We shall not be liable for any failure or delay caused by events outside our reasonable control.

23.2We do not guarantee that eCift will be compatible with all hardware and software. We do not guarantee uninterrupted availability of the Service.

23.3We will not be responsible for any loss or damage that is:

•not reasonably foreseeable;

•caused by your failure to comply with these Terms;

•a business loss;

•caused by your failure to install an update within a reasonable time after we have provided it with adequate instructions; or

•something you could have avoided by taking reasonable steps.

23.4Our total liability to you will be limited to the greater of: (i) the amount paid by you to eCift for the Services in the 12 months prior to the claim; or (ii) EUR 100 (or the local currency equivalent). Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

23.5We are not a party to any arrangement made between members through eCift.

23.6We are not responsible for the conduct of any member. We do not verify statements made by users. We do not conduct criminal background checks on our members, and all age, identity, and selfie verification processes are conducted on a best-efforts basis. We cannot guarantee their accuracy.

VII. General Provisions

24.Feedback

24.1We welcome feedback, comments, ideas, and suggestions for improvements to eCift (“Feedback”). If you submit Feedback, you agree that we may use it freely without restriction or compensation to you.

25.Links To and From eCift

25.1Linking to eCift. You may link to eCift provided you do so in a fair and lawful manner that does not damage our reputation. You must not suggest any form of association, approval, or endorsement by us where none exists. eCift must not be framed on any other website. We reserve the right to withdraw linking permission without notice.

25.2Links from eCift. eCift may contain links to third-party websites and services. We do not control these and accept no responsibility for their content, products, or services. You visit them at your own risk.

25.3For any use of eCift content beyond what is described in these Terms, please contact us at support@ecift.com.

26.Special Provisions for EU, EEA, UK & German Users

26.1General. Where you reside in the UK, European Union, or European Economic Area, your statutory consumer rights are not affected by these Terms. In the event of any conflict between these Terms and applicable local mandatory consumer protection laws, the latter shall prevail.

26.2EU Digital Services Act. For users in the EU, eCift complies with the obligations set out in Regulation (EU) 2022/2065 (the Digital Services Act). You have the right to: (i) access our content moderation reports; (ii) seek out-of-court dispute resolution through a certified DSA dispute settlement body; (iii) lodge a complaint with the competent digital services coordinator in your member state.

26.3UK Consumer Rights. For users in the UK, your rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and other applicable UK consumer protection legislation are preserved.

26.4Consumer dispute resolution. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. We will, however, endeavour to resolve disputes amicably; please contact us at support@ecift.com.

26.5Liability towards consumers in Germany. If you are a consumer habitually resident in Germany, Sections 23.3 and 23.4 are replaced by the following: we are liable without limitation for damage resulting from injury to life, body or health, for damage caused intentionally or through gross negligence, under the German Product Liability Act and within the scope of any guarantee given. In the event of a slightly negligent breach of an essential contractual obligation, meaning an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely, our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, our liability for slight negligence is excluded.

27.Governing Law & Jurisdiction

27.1These Terms are governed by the laws of Türkiye. However, if you are a consumer located in the UK, EU, or EEA, you will also benefit from any mandatory protective provisions of the law of your country of habitual residence, and any dispute may be brought before the courts of your country of residence.

27.2Nothing in these Terms affects your rights as a consumer to bring a claim before the courts in your country of residence.

27.3The courts and enforcement offices of İstanbul (Central, Çağlayan) have jurisdiction over any disputes arising from these Terms with users who are not consumers.

27.4Consumers resident in Türkiye within the meaning of the Turkish Consumer Protection Law No. 6502 (“TKHK”) may, within the monetary limits set annually by the Ministry of Trade, apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) at their place of residence or where the transaction took place and, above those limits and subject to the rules on mandatory mediation, to the consumer courts. Nothing in these Terms removes or limits your mandatory rights under the TKHK.

28.Force Majeure

28.1Neither party shall be liable for late, incomplete or non-performance of its obligations due to force majeure events beyond its reasonable control, including natural disasters, riots, war, strikes, lockouts, failures of telecommunications infrastructure, power outages and adverse weather conditions.

28.2The parties’ obligations are suspended for the duration of the force majeure event. If the force majeure event continues uninterrupted for more than one (1) month, the affected party may terminate these Terms.

29.General

29.1If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

29.2Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

29.3These Terms (together with our Privacy Policy) constitute the entire agreement between you and eCift relating to your use of eCift, and supersede all prior agreements.

29.4We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights or obligations under these Terms.
